Congressman Patrick McHenry (R-NC), Chairman of the House Financial Services Committee, delivered a fireside chat at the Bitcoin Policy Summit 2024 on Tuesday, where he made bold statements about Bitcoin's resilience and the urgent need for the United States to establish clear digital asset regulations.
Bitcoin's Unstoppable Nature
McHenry opened by underscoring Bitcoin's indomitable nature. He pointed out that even the Chinese Communist Party, which attempted to ban Bitcoin, failed to shut it down. Reflecting on Satoshi Nakamoto's creation, McHenry stated: "It's been unstoppable. Every regime that's trying to shut it down has failed." He emphasized that Bitcoin is an unstoppable piece of technology, and he is working to convince policymakers on Capitol Hill to embrace it so that the United States becomes a leader rather than falling behind in this generation of technology.
Regulatory Gaps and Legislative Solutions
The congressman identified a critical lack of definitions in U.S. federal law regarding digital assets. "We have IRS putting out rulings on the tax consequences of owning Bitcoin, but we don't have in federal law a definition of a digital asset. We don't have in federal law a means of exchange for a digital asset. We have to provide that clarity," he said. McHenry argued that without such definitions, the U.S. cannot lead in the crypto space, and legislative action is essential to fill the void.
Two Bipartisan Bills to Watch
McHenry highlighted two pieces of legislation that already passed his committee in July 2023. The first is the FIT for the 21st Century Act (FIT 21 Act), authored by Congressman French Hill. This bill aims to clearly define digital assets, distinguishing between commodities and securities, and creates a means of exchange for digital assets. The second is the Clarity for Payment Stablecoins Act, modeled after New York State's stablecoin definition law. According to McHenry, this bill provides a federal framework for stablecoin regulation, offering clarity on what constitutes a stablecoin. He stated: "These are two pieces of legislation that could provide greater clarity here. They aim to put the U.S. back in the game in both Bitcoin and the broader set of digital assets."
While these bills have not yet advanced to full House or Senate votes, McHenry's remarks underscore a growing bipartisan effort to create a coherent regulatory environment for cryptocurrencies. As the 2024 election season heats up, crypto policy is becoming a key issue, and McHenry's advocacy reflects a broader recognition that the U.S. must act swiftly to maintain its competitive edge in financial technology.
