SEC Faces August 15 Deadline
The U.S. Securities and Exchange Commission (SEC) is approaching a critical milestone in its long-running lawsuit against Ripple Labs. Legal expert Bill Morgan stated on social media platform X that the SEC has yet to withdraw its appeal in the Ripple matter, but the appellate court requires a status report by August 15, 2025. “There is no deadline for the SEC to withdraw the appeal,” Morgan explained. “However, the SEC needs to report to the appeal court by August 15, which acts as a deadline for the SEC to do something, although it may just ask for more time. We will hear something about the matter in the next two weeks.”
The case, originally filed in December 2020, centered on whether Ripple’s sales of the XRP cryptocurrency constituted unregistered securities. In a landmark 2023 ruling, U.S. District Judge Analisa Torres determined that institutional sales of XRP were securities, but programmatic sales on exchanges were not. Both parties subsequently reached a settlement agreement, but Judge Torres rejected the proposed deal to reduce the penalty and dissolve an injunction, prolonging the legal saga.
XRP Gains Institutional Traction, ETF Hopes Rise
Despite the unresolved legal battle, XRP has recently seen a surge in adoption driven by several factors. The partial regulatory clarity from the court ruling has fueled institutional interest, with companies viewing XRP as a more viable asset for treasury reserves. Its utility as a fast, low-cost bridge currency for cross-border payments continues to attract financial institutions and corporate treasuries.
Meanwhile, the growing possibility of a spot XRP exchange-traded fund (ETF) is opening a pathway for mainstream adoption. Several asset managers have filed applications with the SEC, and market analysts estimate that approval could unlock billions of dollars in capital inflows. The ETF narrative has further boosted XRP’s price and trading volumes in recent weeks.
Ripple Withdraws Appeal, SEC Silent
Ripple announced it had withdrawn its own appeal, but the SEC has not followed suit. Legal observers suggest the SEC’s hesitation may reflect internal strategy debates or a desire to seek a more favorable settlement. If the SEC fails to take concrete action by August 15, Judge Torres could potentially dismiss the appeal, handing Ripple a decisive victory.
The XRP community remains on high alert. A final resolution of the case would remove the last major regulatory cloud over XRP, paving the way for broader institutional adoption and eventual ETF approval.
