The April Window: A Make-or-Break Period

The Senate Banking Committee had circled the weeks of April 13 and April 20 as critical dates to schedule a markup — the essential step before a full floor vote. But as of April 21, no vote has been scheduled. If the markup does not happen in April, the path to a Senate vote in May vanishes. After May, Congress will pivot to midterm election campaigns, a phase during which major new legislation rarely passes.

On the policy side, the bill has actually gained momentum. Coinbase, a major opponent just months ago, now publicly endorses the measure. The White House released a report stating that stablecoins do not threaten traditional banks. However, three sticking points remain: banks and crypto firms disagree on whether stablecoins should pay interest; law enforcement raises concerns about DeFi safe harbor rules; and Republican committee members have yet to align on the final text.

Investor sentiment has soured sharply. On Polymarket, the probability of the bill passing in 2026 has fallen from 80% earlier this year to just 49%. Senator Thom Tillis, a key negotiator, hinted the markup could slip into May. While this keeps the bill alive temporarily, the window for success is now extremely narrow. Many analysts believe that if the bill misses mid-May, it will die in its current form and won't be revived until 2027 or later.

Senator Lummis warned that missing the 2026 window, combined with midterm elections and shifting political priorities, could delay another serious attempt at a comprehensive crypto market structure bill until 2030.

Three Consequences of Failure

If the Crypto Clarity Act fails to pass, the U.S. faces a triple blow:

Loss of global leadership: Capital and developers will likely migrate to regions with clear rules, such as the EU (MiCA), Singapore, and the UAE.

More lawsuits, fewer rules: Without a federal law, the SEC-CFTC turf war will continue. Rules will be set through expensive, multi-year litigation rather than clear legislation.

Stalled institutional investment: Banks and hedge funds will remain on the sidelines due to regulatory fog.

The U.S. domestic market risks becoming isolated while the rest of the world advances blockchain infrastructure.

All eyes are on Senator Tim Scott. If he calls a surprise meeting by Friday, the bill still has a fighting chance. If the week ends without a schedule, U.S. crypto regulation will face prolonged uncertainty.
