The Guangdong High People's Court has released its 2025 top ten commercial and financial cases, including a virtual currency loan dispute where the repayment clause 'whichever is higher' was ruled invalid for guaranteeing the lender's profit from price fluctuations. The Guangzhou Intermediate Court ordered the borrower to compensate the lender based on the original acquisition cost of the virtual currency, amounting to 199,600 RMB per coin.

Guangdong High People's Court has released its 2025 list of the ten leading commercial and financial cases, and one of them centers on a virtual currency loan fight. The court said the repayment term in the loan contract — the one using the phrase 'whichever is higher' — in effect guaranteed the lender a gain from swings in the virtual currency's price, so that clause was invalid.

Because the virtual currency itself could not be returned, the Guangzhou Intermediate Court held that the borrower had to compensate the lender using the virtual currency's original purchase cost: 199,600 RMB per coin.
