Ex Populus, a Web3 gaming platform, has filed a trademark infringement lawsuit against Elon Musk's artificial intelligence company, xAI, in the Northern District of California. The legal action aims to protect its Xai brand, which the company claims has been used publicly since at least June 2023. Ex Populus provided a copy of the complaint as evidence and argues that trademark law obligates it to act against the dilution of its brand and harm to its developer and user community.

The lawsuit alleges that xAI's recent signals of entering the gaming and blockchain sectors have caused widespread confusion in the market. Ex Populus states that its Xai brand, built around a blockchain gaming platform, has established distinct recognition among developers and gamers. The company insists it will not comment further on the active litigation but will continue focusing on its blockchain gaming ecosystem.
Earlier this year, in March, xAI completed a significant corporate merger by acquiring X (formerly Twitter). This acquisition gave xAI a massive user base and social media distribution channel, which industry observers believe will be leveraged for gaming and blockchain initiatives. Ex Populus contends that xAI's use of the “Xai” mark in these verticals directly infringes on its registered trademark.

The platform has secured investment from notable institutional backers and partnered with multiple game projects. xAI, founded by Elon Musk, focuses on artificial intelligence research and development. Its latest product, the Grok chatbot, has been integrated into X's platform. Following the acquisition of X, xAI gained access to vast social data and traffic, and has repeatedly signaled plans to expand into Web3 and blockchain markets. Ex Populus's lawsuit comes just as xAI announces these plans, highlighting the escalating trademark conflict.
