The U.S. Commodity Futures Trading Commission (CFTC) has approved BTCPERP as the first regulated perpetual futures contract, moving crypto derivatives into a compliance framework. Chairman Michael S. Selig said court precedents and the agency's interpretation of "futurity" allow infinite-duration instruments tied to price exposure rather than fixed expiration. This classification brings perpetual contracts—with funding rates and cash settlement—under existing derivatives law, bridging offshore innovation with U.S. oversight.

Futurity Redefined: Price Risk Over Fixed Maturity

Selig noted that the Commodity Exchange Act does not explicitly define "futures contract"; courts have long interpreted "contracts for future delivery" using multiple market factors. Perpetual contracts' lack of expiry does not disqualify them—futurity includes expectation of future price or value, not fixed dates. He emphasized that cash-settled derivatives and funding rates have existed in U.S. markets, supporting regulatory flexibility.

BTCPERP's approval sets a precedent: as long as a contract anchors to spot prices via funding rates and settles in cash, it meets the legal test for "future delivery." This opens the door for similar products seeking formal oversight.

New Hires Boost Data Science and Blockchain Forensics

Alongside the product approval, the CFTC announced two senior appointments. Donald Battle becomes Chief Data Innovation Officer within the Division of Data, also serving on the Innovation Task Force for data science and blockchain forensics. Battle previously worked on the SEC's Crypto Task Force under Commissioner Hester Peirce and at FinCEN on virtual currency enforcement and anti-money laundering.

J Matthew Haws was named Senior Advisor and Chicago Regional Administrator. With over 13 years of derivatives legal and compliance experience, he previously held regulatory roles at Marex and Katten Muchin Rosenman LLP.

These hires signal the CFTC's intent to strengthen on-chain data analysis and enforcement technology. Analysts view the appointments as critical for monitoring novel products like perpetual futures and managing market risks.

Specific trading rules for BTCPERP are pending. The CFTC stated it will continue evaluating other perpetual-style products based on court authority and its classification powers.
