OKX founder Star Xu says tighter oversight on Binance may reduce regulatory arbitrage, shifting exchange competition from regulatory advantages to products, governance, and compliance.

After a Reuters report suggested Greece's Hellenic Capital Market Commission might reject Binance's MiCA license application, OKX founder and CEO Star Xu weighed in. Xu argued that stricter regulation of Binance could curb regulatory arbitrage across the crypto industry, pushing exchanges to compete on products, governance, compliance, and user trust rather than regulatory loopholes.

End of the Regulatory Loophole Era

Xu noted that over the past decade, competition has often favored companies operating under lighter regulatory requirements. If Binance faces rigorous oversight across major jurisdictions, that advantage erodes. Exchanges will need to differentiate through technology, execution, governance, and customer service, not regulatory gaps.

Xu emphasized that regulators increasingly assess whether compliance programs actively reduce risk, not just check procedural boxes. He argued that the effectiveness of controls matters more than headcount, referencing reports about Binance's historical operations—including Russia-linked CommEX and founder Changpeng Zhao's controversies.

Binance's Ecosystem: Two Sides

Xu acknowledged that Binance built a powerful ecosystem over the past decade through liquidity, token listings, social media influence, and market narratives. Its network spans founders, venture funds, incubated projects, and partners. But Xu pointed out that while some projects succeeded, many others recorded steep price declines later.

He did not judge the validity of allegations, deferring to regulators and courts, but noted lingering questions about Binance's compliance culture and risk management.

What MiCA Means for Binance

The debate unfolds as Binance pursues authorization under Europe's Markets in Crypto-Assets (MiCA) framework. Binance has stated it remains committed to securing a MiCA license to operate under harmonized European rules. Xu said the regulatory process reflects a broader industry transition: global regulators are focusing on governance standards, operational controls, and long-term accountability. Crypto firms must adapt.

If Binance is denied a MiCA license, it could reshuffle European exchange market share. But Xu stressed that a level playing field benefits the entire industry in the long run.
