China’s Ministry of Commerce and Ministry of Science and Technology have proposed adding 23 AI technologies to the country’s export control list, covering large language models, agents, and computing clusters. Under the proposal, a model’s core technology could face restrictions if it meets any one of three thresholds: training compute of 10^26 floating-point operations, 2 trillion parameters, or a top-10 ranking in major global public evaluations. The proposed controls would cover model weights, underlying source code, architecture design, and training optimization technologies. Still, the draft does not amount to a blanket ban on open-sourcing Chinese AI models. Open-source technologies that have already entered the public domain would remain outside the new rules, and newly open-sourced restricted technologies could go through a fast-track licensing process. The Ministry of Commerce said it can basically achieve a filing-and-release process with immediate handling. The proposal also states that overseas users accessing Chinese models through APIs, websites, or apps would not fall under the export control scope. What would be restricted is the transfer of core technologies abroad, such as handing model weights to overseas companies or carrying out localized deployment outside China. The draft is open for public comment until Nov. 15, while pre-export registration requirements for the related technologies took effect on Oct. 16.

China’s Ministry of Commerce and Ministry of Science and Technology have proposed placing 23 AI technologies under export controls, including large models, agents, and computing clusters.

For large models, core technology could be restricted if the model meets any one of three conditions: training compute reaches 10^26 floating-point operations, parameter count reaches 2 trillion, or the model ranks in the top 10 of major global public evaluations.

The proposed scope covers model weights, underlying source code, architecture design, and training optimization technologies.

The draft does not mean Chinese large models will no longer be allowed to open-source. Open-source technologies already in the public domain would not be bound by the new rules. Newly open-sourced technologies that fall within the restricted category could still go through a fast-track licensing procedure. The Ministry of Commerce said it can basically achieve 「即报即出」 (immediate filing and release).

Overseas users who continue to access Chinese models through APIs, websites, or apps are also outside the scope of this round of export controls on large-model technology. What would actually be constrained is the transfer of core technologies overseas, such as providing model weights to foreign companies or carrying out localized deployment abroad.

Some technologies involving China’s core data, national defense, and other sensitive fields are also proposed to be banned from export.

The new catalog is still open for public comment until Nov. 15, but pre-export registration requirements for the related technologies took effect on Oct. 16.
