A federal judge has dismissed xAI’s trade secrets lawsuit against OpenAI and denied xAI permission to amend its complaint. The case centered on whether OpenAI, during its hiring process, induced former xAI engineers to reveal trade secrets connected to the Grok chatbot.
Judge rejects xAI’s hiring-related claims
U.S. District Judge Rita Lin ruled that xAI failed to show OpenAI had encouraged former engineers to disclose confidential information. The judge stated that asking job candidates to discuss their prior work is part of a normal hiring process and does not, by itself, amount to inducing the disclosure of trade secrets.
Rita Lin also noted that accepting xAI’s theory would expose employers to legal risk whenever they ask applicants about their previous work experience. Separately, Elon Musk had previously sued OpenAI, Sam Altman and co-founder Greg Brockman over claims that OpenAI had departed from its nonprofit mission. That lawsuit was rejected last month by a federal jury, according to Decrypt.
