BPI2026-10-03 02:18:10BPI challenges MSCI over proposed "non-operating company" rule affecting Strategy and MetaplanetThe Bitcoin Policy Institute, or BPI, has accused MSCI of using a broad "non-operating company" framework to disguise what it says is an earlier effort to exclude digital asset treasury companies from major indexes. In a report titled Wall Street’s Invisible Committee, BPI said metadata from MSCI’s consultation materials pointed to an internal folder labeled "digital asset treasury companies," which it argues links the current proposal to a 2025 crypto-specific exclusion plan. MSCI’s screening method would first assess whether a company has substantial operating assets and then apply five financial tests. Under MSCI’s own simulation, Strategy, Metaplanet, and uranium investment firm Yellow Cake would be removed from the MSCI Global Investable Market Indexes. BPI also argued that "operating assets" is not a standard balance-sheet category under GAAP or IFRS, giving MSCI broad discretion over classifications. The consultation period closed on Sept. 30, and MSCI is expected to announce the outcome by Oct. 16. Any revised rule is set to take effect in the November 2026 index review.390

Policy Regula2026-08-23 05:34:49BPI urges FinCEN to extend KYC rules to secondary stablecoin marketsThe Bank Policy Institute, a banking industry group representing major U.S. lenders including JPMorgan, Bank of America, Wells Fargo, and Citi, has proposed that the Financial Crimes Enforcement Network extend customer identification program requirements to the secondary market for stablecoins. The proposal would apply to exchanges and other platforms that maintain direct account relationships with retail users. According to BPI, a large share of buying and selling activity in the payment stablecoin ecosystem takes place on those venues, and most illicit activity tied to stablecoins occurs there as well. If adopted, the change would require covered platforms to collect customer information under the Bank Secrecy Act. The group’s proposal also suggests that decentralized exchanges could fall within the scope of oversight. FinCEN’s proposed rule says secondary-market stablecoin transactions on blockchains often involve anonymous or pseudonymous identities and lack a centralized point for gathering identity data, limiting issuers’ ability to collect customer information from secondary-market users. BPI has also previously opposed the current version of the Digital Asset Market Clarity Act alongside other banking groups.1260

Policy Regula2026-07-11 12:04:48BPI Moves to Join 'Abandoned Bitcoin' Case, Seeks Dismissal of ClaimsA legal dispute tied to "Noah Doe" and an effort to claim ownership of Satoshi Nakamoto’s bitcoin has taken a new turn, according to a post on X by Galaxy head of research Alex Thorn. The Bitcoin Policy Institute, or BPI, has formally moved to intervene as a defendant in the so-called abandoned bitcoin case and is seeking to push for the court to dismiss the entire lawsuit. Thorn said BPI, represented by law firm White & Case, filed not only its motion to intervene but also a proposed answer, 15 affirmative defenses, and plans for a motion to dismiss. BPI argued it has standing to intervene because it self-custodies part of its bitcoin reserves for an indefinite holding period. Under the plaintiff’s theory that long-unused bitcoin can be treated as abandoned, similar holdings could face future litigation. Thorn said the case is not limited to assets linked to Satoshi, because a court endorsement of that legal theory could create a precedent affecting the ownership rights of long-term self-custody bitcoin holders more broadly.1800
