The Commodity Futures Trading Commission (CFTC) has filed a motion with the New York Southern District Court seeking massive penalties against Michael Ackerman, the alleged mastermind of a fraudulent cryptocurrency scheme. The agency demands $27 million in restitution and an additional $81 million civil monetary penalty, totaling over $100 million. The motion was filed jointly with the U.S. Securities and Exchange Commission (SEC).
Deceptive Algorithm and Investor Lures
According to court documents, Ackerman, a former stockbroker, used two entities—Q3 Trading Club and Q3 I, LP—to raise approximately $33 million from more than 150 investors. He promised to deploy a “special algorithm” that would maximize returns in the crypto market. In reality, Ackerman invested no more than $10 million in cryptocurrencies, and the algorithm’s actual profits were “minimal at best,” the CFTC said.
Lavish Spending and Fake Evidence
Instead of investing the bulk of the funds, Ackerman used the money to purchase and renovate a new home, pay over $600,000 for personal security services, spend more than $100,000 on jewelry at Tiffany & Co., and buy three cars. To conceal the fraud, he allegedly doctored screenshots of account balances and provided falsified information to investors, making the scheme appear legitimate.
Default Judgment and Regulatory Crackdown
Since Ackerman failed to appear at the initial motion hearing, the CFTC is requesting a default judgment. This case marks another milestone in U.S. regulators’ aggressive push to clean up the crypto space. The coordinated action between the CFTC and SEC underscores a zero-tolerance stance toward fraudulent crypto schemes. If granted, the total financial penalty would exceed $108 million, serving as a strong deterrent.
